SECTION 21 - SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS
Beibiehair LLC has a mobile messaging program available for use, but only if you agree to the Mobile Messaging Terms and Conditions and Privacy Policy. By choosing to participate in any of our Programs, you are accepting and agreeing to these terms and conditions, which include resolving any disputes with us through binding, individual-only arbitration, as outlined in the "Dispute Resolution" section below. This Agreement is specific to the Program and does not alter any other Terms and Conditions or Privacy Policy that may apply to your relationship with us in other situations.
User Opt In: Users can receive SMS/MMS mobile messages through the Program by opting in through online or application-based enrollment forms. Regardless of how you joined the Program, you are bound by this Agreement. By participating in the Program, you agree to receive marketing mobile messages at the phone number associated with your opt-in, and you acknowledge that you do not need to give consent to make any purchases from Us. Although you agree to receive messages sent using an autodialer, this does not mean that all of Our mobile messages are sent using an automatic telephone dialing system ("ATDS" or "autodialer"). Message and data rates may apply.
User Opt Out: If you want to stop participating in the Program or no longer agree to this Agreement, you can opt out by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us. We may send you a confirmation message to confirm your decision to opt out. You acknowledge that these are the only reasonable ways to opt out, and that any other methods, such as texting different words or asking our employees to remove you from our list, are not reasonable means of opting out.
Duty to Notify and Indemnify: If you plan to stop using the mobile number that you used to subscribe to the Program, such as canceling your service plan or transferring the number to someone else, you must complete the User Opt Out process before discontinuing the use of the number. You acknowledge that this is an important part of the terms and conditions. If you fail to notify Us of the change and someone else is assigned the number, you will be responsible for any costs or liabilities incurred by Us or any party involved in delivering the mobile messages due to claims brought by the new user. This responsibility and agreement will continue even if you cancel or terminate your participation in any of our Programs.
YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.
Program Description: The Program offers a wide range of content, and users who choose to participate should anticipate receiving messages related to the promotion and sale of both digital and physical products, services, and events.
Cost and Frequency: Please note that standard message and data rates may apply when participating in the Program. The Program includes recurring mobile messages, and you may receive additional mobile messages from us based on your engagement with our content.
Support Instructions: If you need assistance with the Program, please send an email to info@Beibeihair.com. Kindly be informed that utilizing this email address to opt out of the program is not an approved method. Opting out should be done following the procedures outlined above.
MMS Disclosure: In case your mobile device is unable to receive MMS messages, the Program will send SMS TMs (terminating messages).
Our Disclaimer of Warranty: The Program is provided without any guarantees and may not be accessible in all regions or at all times. It may also cease to function if your wireless carrier makes changes to their product, software, or coverage. We are not responsible for any delays or failures in receiving mobile messages related to this Program. The delivery of mobile messages is dependent on the successful transmission from your wireless service provider or network operator, which is beyond our control. T-Mobile cannot be held accountable for mobile messages that are delayed or not delivered.
Participant Requirements: To participate, you need to have your own wireless device that can send and receive messages, be subscribed to a participating wireless carrier, and have text messaging service. However, not all cellular phone providers offer the required service. Please check your phone's capabilities for specific instructions on how to send text messages.
Age Restriction: If you are under the age of thirteen (13), you are not allowed to use or interact with the Platform. If you are between the ages of thirteen (13) and eighteen (18), you must obtain permission from your parent or legal guardian before using or interacting with the Platform. By using or interacting with the Platform, you confirm that you are not under the age of thirteen (13), have obtained permission from your parent or legal guardian if you are between the ages of thirteen (13) and eighteen (18), or are of legal age in your jurisdiction. Additionally, you acknowledge that it is legal in your jurisdiction to use and/or interact with the Platform.
Prohibited Content: By using the Platform, you accept and consent to refrain from transmitting any content that is prohibited. This includes:
- Any activity that involves fraud, slander, defamation, scandal, intimidation, harassment, or stalking;
- Content that is deemed objectionable, such as the use of profanity, obscenity, sexual content, violence, prejudice, animosity, and discrimination based on factors such as race, gender, religion, nationality, disability, sexual orientation, or age;
- Illegally copied software, malicious software such as viruses, worms, Trojan horses, or any other type of harmful code;
- Any item, offering, or advertising that is illegal in the location where it is received;
- Any material that involves or alludes to confidential health data that is safeguarded by either the Health Insurance Portability and Accountability Act ("HIPAA") or the Health Information Technology for Economic and Clinical Health Act ("HITEC" Act);
- Any content that is not allowed by the law in the place where the message is sent is also prohibited.
Dispute Resolution: If there is a disagreement, assertion, or conflict between you and Us, or between you and any other third-party service provider who is helping Us send mobile messages as part of the Program, related to federal or state legal claims, this Agreement, or any breach, termination, enforcement, interpretation, or validity of it, including whether this agreement to arbitrate applies, then the disagreement, assertion, or conflict will be resolved through arbitration in Needham, Massachusetts with one arbitrator, as allowed by law.
The parties have agreed to resolve any disputes through binding arbitration, following the Commercial Arbitration Rules of the American Arbitration Association (AAA) that are currently in effect. The arbitrator will apply the substantive laws of the Federal Judicial Circuit where Beibeihair LLC's main office is located, without considering its conflict of laws rules, unless otherwise stated. Within ten (10) days of receiving an arbitration demand, the parties must jointly select an arbitrator with at least five years of experience and knowledge of the dispute's subject matter. If they cannot agree on an arbitrator, a party may ask the AAA to appoint one who meets the same experience requirement. The arbitrator will decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (FAA) if there is a dispute. The parties also agree that the AAA's Emergency Measures of Protection rules will apply instead of seeking emergency injunctive relief from a court. The arbitrator's decision will be final and binding, and neither party will have the right to appeal except as provided in section 10 of the FAA. Each party will pay its share of the arbitrator's and arbitration administration fees, but the arbitrator may order one party to pay all or part of these fees as part of a well-reasoned decision. The arbitrator can only award attorneys' fees if authorized by statute or contract. The arbitrator cannot award punitive damages, and both parties waive the right to seek or recover punitive damages in any dispute resolved through arbitration. The parties agree to arbitrate individually, and this agreement does not allow for class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. Unless necessary to protect or pursue a legal right, neither party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties. If any term or provision of this Section is invalid, illegal, or unenforceable in any jurisdiction, it will not affect any other term or provision of this Section or invalidate or render unenforceable such term or provision in any other jurisdiction. If a dispute proceeds in court instead of arbitration, the parties waive the right to a jury trial. This arbitration provision will remain in effect even if the agreement to participate in any of our Programs is canceled or terminated.
Miscellaneous: You guarantee and affirm to Us that you possess all the essential rights, authority, and power to accept these Terms and fulfill your duties as per this agreement. Furthermore, nothing in this Agreement or the execution of such obligations will result in a violation of any other contract or obligation. The non-exercise of any right provided in this Agreement by either party will not be considered as a waiver of any further rights under this Agreement. If any provision of this Agreement is deemed unenforceable or invalid, it will be restricted or removed to the minimum extent necessary to ensure that this Agreement remains fully enforceable and effective. Any new features, updates, changes, or enhancements to the Program will be subject to this Agreement unless explicitly stated otherwise in writing. We hold the right to modify this Agreement periodically. Any updates to this Agreement will be conveyed to you. You acknowledge your responsibility to review this Agreement periodically and stay informed of any changes. By continuing to participate in the Program after any such changes, you accept this Agreement, as amended.
OTHER TERMS AND CONDITIONS:
Please take the time to carefully read this information as it contains important details regarding your rights and obligations, as well as any limitations or exclusions that may apply to you. We strive to fulfill each order according to your exact specifications, but please note that our natural hair is 100% virgin human hair and comes from individual donors, so we cannot guarantee the exact color or texture of each piece. Our natural hair is available in straight, wavy, or curly patterns, with colors ranging from natural 1b to 2. We may have lighter pieces available upon request, but this cannot be guaranteed. If you are not satisfied with the color or texture of your purchase, you may request a prepaid label to return the hair, and we will do our best to fulfill your request based on our current inventory. However, any future exchanges will be at your own expense.
If you return any unused and original condition product from our KERATIQUE COLLECTION within 30 days of purchase, we will refund the original payment method. However, if you have already installed Keratique, we cannot exchange the product due to the risk of incorrect installation.
If you have purchased BULK HAIR and decide to return it within 30 days of the purchase date, as long as it is unused and in its original condition, we will refund your payment using the original payment method. However, if you have already installed the Bulk Hair, we cannot accept returns due to the risk of incorrect installation, which could cause the hair to become inverted. Therefore, our Product Defective Exchange Policy does not apply to installed Bulk Hair.
Once you purchase any item from the Beibeihair CARE ESSENTIALS COLLECTION and DESIGN ESSENTIAL PRODUCTS, it cannot be returned or exchanged. All sales are considered final.
Payment Terms:
We require full payment in advance for all orders and accept all major credit cards. When you make an online purchase, your credit card will be charged immediately. It's important to carefully review your order, items, and shipping details before submitting your payment, as once the payment is processed, no changes can be made without canceling the entire order. If you do cancel your order, please note that your bank may hold the authorized funds for up to 5 business days. We cannot control this, so please ensure that your order information is accurate to avoid any issues.
We take credit card fraud and theft of our merchandise very seriously and will pursue legal action to the maximum extent allowed by law. In the event that your billing address differs from your shipping address, we will require you to complete a credit card authorization form and provide supporting documents before we can release your shipment. If this is necessary, one of our representatives will contact you promptly after you have placed your order.
Order Processing:
Our shipping hours are Monday through Friday from 9:00 am to 3:30 pm EST. All orders MUST BE received with any necessary supporting documents and approved for fulfillment, including approval from our payment processing company to ship the order, before 3:30 pm in order to be shipped the same day. Orders placed over the weekend will be shipped first thing Monday morning unless it is a holiday. Once shipped, orders arrive within the time frame selected during order placement. PLEASE NOTE: Shipping hours end at 2:30pm on Fridays from Memorial Day until Labor Day.
Product Availability:
In the event that a product is not available due to being out of stock or for any other reason that prevents us from fulfilling your order, we will promptly reach out to you to inquire if you would like to receive a replacement item. If a replacement is not satisfactory, you have the option to cancel the sale and we will issue a refund to your credit card for the amount charged.
Kindly take note that the prices, specifications, and availability of our products may change without prior notice. In the event of any typographical, photographic, or specification errors in our products or pricing, we reserve the right to make necessary corrections. Rest assured that we will inform you of any changes or corrections and seek your approval before finalizing your order.
Return & Replacement Policy:
At Beibeihair, we are committed to providing you with the highest level of quality assurance. Our hair is carefully prepared and packaged by our professional team at our factory in India, ensuring that you receive the best possible product. We have a strict process in place to ensure that every order meets our high standards, and we thoroughly inspect each one before shipping it to you. Our top priority is your satisfaction, and we strive to make sure that you are completely happy with your purchase.
Beibeihair reserves the right to occasionally allow returns of certain products or parts of products, except for Wigs, Hair Care Products, Bulk Hair, and Keratique Collection. These returns must meet specific conditions as determined by Beibeihair.
- You can return the item(s) you bought within 30 days from the date of purchase. However, if you request a return after 30 days from the purchase date, we won't be able to accept it.
- To initiate the return process, it is necessary to send the product(s) back to us.

After we receive your item(s) at our main office, we will conduct a thorough inspection. If the product is in its original condition and has not been used, we will refund your payment using the same method of payment. Your refund will be processed within 3 to 5 business days, depending on your bank's processing time.
Replacements:
Beibeihair has a policy that allows customers to exchange defective products within 30 days of purchase. This policy starts from the day of purchase. If you bought the product online or over the phone, you should contact client care at info@Beibeihair.com to report any issues or concerns. If you bought the product at a Beibeihair Boutique, you should contact the boutique where you made the purchase. Please be aware that if you perm, color, lift, rinse, cut, remove hair from the weft, or otherwise process the hair, you will no longer be eligible for the product exchange policy.
Wig Exchanges and Refunds:
Upon receiving your wig, it is mandatory to use the wig cap provided to try it on for size. This is to ensure that the wig remains in its original, unused condition. It is important to keep the original packaging intact and refrain from sewing on the wig or adding any clips or bands. In case the wig does not fit as anticipated, kindly refer to our refund and exchange policy.
If you want to request a refund or exchange, you need to do so within 7 days from the day you bought the wig. We will only accept refunds and exchanges for wigs that are new and unused. You must keep all the original tags and packaging, and provide your original receipt when returning the wig.
If your wig has been modified or if it seems like it has been used, we regret to inform you that we cannot accept any requests for refunds or exchanges. This policy covers a range of actions, such as cutting the wig's lace or hair, removing original tags, and using styling tools like flat irons or hair dryers. We cannot accept refunds or exchanges if the wig has been chemically altered, or if hair products, perfumes, or adhesives have been applied to it. Additionally, any damage to the wig's base, including tears or punctures from sewing needles, will not be eligible for refunds or exchanges.
Shipping Delays:
To ensure a smooth and stress-free ordering experience, we recommend placing your order well in advance of any important deadlines or engagements. This will allow for any unexpected delays that may arise during the shipping process. Our shipping partner, UPS, will provide an estimated delivery date when you place your order. However, please note that we cannot be held responsible for delays caused by inclement weather, holidays, natural disasters, or carrier issues. It's important to keep in mind that holidays are not considered business days and should be factored into your shipping calculations. We trust UPS to deliver your package on time, but unfortunately, we cannot offer reimbursement for shipping charges in the event of a delay. Failed Deliveries / Refused Shipments / Incorrect Shipping Address:
The primary reason for delays in shipping is due to incomplete or inaccurate address details. Your package will be delivered by UPS to the address you provide, so it is crucial that you provide us with the most precise and comprehensive information possible. If any changes need to be made to the address after the shipment has been dispatched, you will be charged a $10 fee by UPS. Lost Shipments:

Discounted Products:
Only certain discounted products are eligible for returns. If you made a purchase at a promotional event, in-store event, or online at Beibeihair.com using a Promotional (Promo) Code, Beibeihair Pink Certificate, or any other discounting method provided by Beibeihair, LLC, you can return the item within 30 calendar days from the date of purchase. If you purchased an item on sale, you can also return it within 30 calendar days and apply the sale promotion to a new order if applicable. For instance, if you bought Pure Curly hair on sale and want to exchange it for another length of Pure Curly, you can get the sale price on the new order. However, if you return the Pure Curly hair for Pure Straight, the discount will not apply. Purchases made at trade shows or received as prizes or for compensatory purposes are not eligible for returns. Sample sale items are FINAL SALE and cannot be returned for a refund.
PRICE ADJUSTMENTS:
Clients who have obtained products through a promotional contest or event are not allowed to make returns, replacements or exchanges. Additionally, hair acquired through a compensation contract from any Beibeihair department cannot be returned, replaced or exchanged.

Right to Terminate Program and Points:

Customer Referrals:
To earn referral points, the initial purchase made by a new customer must be at least $170.
Combining Reward Points:
It is not possible to use multiple Beibeihair Rewards coupons or prizes in a single transaction. However, if specified, certain promotions and Bundle Deals can be combined with reward coupons. It is important to note that reward coupons cannot be used on Remix Bundle Deals.
